Default commission terms and conditions

Here you will find the default (non-disclosure) terms and conditions. In some cases the contract may require edits. This is just the standard go-to.
If edits are required I will do so before sending the contract your way.

Payment

  • Payments exclusively occur through PayPal and in € Euro’s.
  • The first half of the payment will occur after we discuss the subject
  • The second half of the payment will occur right after the flat coloring phase and before the rendering phase.

Delivery time

  • The time it takes to finish the commission may vary between 1 week to 1 month depending on the complexity of the work. This will be specified at the start date of the project, which may not always be right away.

Ownership and what you can and cannot do with the art

  • Unless otherwise specified, this contract includes the non-exclusive rights for the artwork. You can use the art for promotion, but you cannot monetize or resell it. Using it as a background/intros/outros or educational purposes on social media channels like Youtube and Twitch, which are then monetized is fine.
  • You are free to post the art to websites and social media channels. Using the signed version or referring to me is very much appreciated, but not required.
  • I will not claim the intellectual property (IP) of the commissioned artwork.
  • I will never agree on my art being used for the following topics*: Politics, bullying, abuse, and racism. *Don’t hesitate though to contact me if you promote awareness and/or have educational purposes. These topics need to be fully unbiased and educational to be approved. A clause will be added to clarify.
  • You can use the art for any project we discussed.
  • Monetizing the artwork yourself can be discussed and will be specified. This may or may not include selling you additional rights.
  • You cannot edit the image other than: Adding text, flipping the canvas, adding a frame, or zooming in.
  • I do keep the rights of the image (Industry standard). I won't sell my copyright but can sell additional rights for the specified usages.* *If you at some point use it for political, discriminating, abuse,or bullying purposes, and/or you become known publicly for related offenses, you will lose all rights to using my art indefinately.
  • If full payment doesn't occur, the final illustration won't be sent to you. You cannot use any of the art in any way, shape, or form. This includes the sketches, concepts, and flat-colored versions. I’m then free to sell the artwork to someone else or as prints after editing it in such a way that it’s no longer recognizable as your IP.
  • Unless otherwise specified I will always be able to use the art in my portfolio or websites, this includes the websites: www.tezartdesign.com and www.lifetolegend.com and corresponding social media channels. This also includes publications such as art books. I will refer to you or your project in return. I will wait with sharing if you have a specific release date for the art.

Cancellation and refund policy

  • The buyer is not allowed a refund once I start working on the commission.
  • If for any reason I am unable to start your commission you will receive a full refund.
  • If you cancel your order before I started with the commission you will receive a full refund.
  • If you receive a fund back, please do not request a Paypal chargeback. I will transfer the money back to you myself.
